Largest action against sites with free content

By Alex Dobuzinskis

LOS ANGELES, June 30 (Reuters) – U.S. authorities seized nine websites on Wednesday, accusing them of movie piracy by offering free access to movies such as "Toy Story 3".

Kevin Suh, vice president of content protection for the Motion Picture Association of America, a Hollywood trade group, called the action, "Operation In Our Sites", the "largest takedown of illegal movie and television websites in a single action by the federal government."

It involved U.S. Immigration and Customs Enforcement and other law enforcement agencies, and came a week after the White House unveiled an enforcement plan for tackling theft of intellectual property.

Warrants were issued in Manhattan federal court to shut down seven websites: TVshack.net, Movies-Links.tv, FilesPump.com, Now-Movies.com, PlanetMoviez.com, ThePirateCity.org and ZML.com.

NinjaVideo.net and NinjaThis.net were also shut down in another action, but authorities declined to give the location because the investigation is ongoing.

"If your business model is movie piracy, your story will not have a happy ending," Preet Bharara, U.S. Attorney for the Southern District of New York, said in a statement.

Bharara said copyright infringement over the Internet costs the U.S. economy billions of dollars.

Suh said past crackdowns have focused on the sale of pirated content, such as DVDs copied illegally.

This latest action marks a move to target websites that offer pirated content for free and make money by selling advertising or seeking donations.

"Their (the federal government’s) shift in focus toward this kind of enforcement is extremely positive," Suh said.

TVshack.net showed an image for the Disney/Pixar movie "Toy Story 3," which is in its second week in theaters, with the words "Watch now."

Other websites targeted in the action had links to such films as "Knight and Day," "Jonah Hex" and "Prince of Persia: The Sands of Time," which are all playing in theaters.

The U.S. Attorney for the Southern District said in a statement that Movies-Links.TV had about 3.3 million visitors per month.

Immigration and Customs Enforcement said in a statement that as part of the action, authorities had seized assets from 15 banks, the e-commerce service Paypal and from investment and advertising accounts, but it did not elaborate on the assets. It also said that four residential search warrants had been carried out.

Pat Reilly, a spokeswoman for Immigration and Customs Enforcement, said authorities would replace content on the websites with a banner saying the destinations had been shut down.

Reilly said further actions were expected against the operators of the websites.

Authorities did not disclose the names of the operators of the websites. (Reporting by Alex Dobuzinskis: Editing by Bob Tourtellotte)

Leaked builds of Windows 7 hitting file sharing networks are claiming to be "very, very possible FINAL RTM build."

More than one piracy scene group today released iso disc images that bear the build string and filename "7600.16385.090713-1255_x86fre_client_en-us_Retail_Ultimate-GRMCULFRER_EN_DVD.iso."

It’s unclear how different this is from build 7600 that leaked onto the internet last Sunday, though the filename indicates that it was compiled on July 13, 2009 at 12:55 p.m., making it a few days newer than the one previously leaked.

Microsoft did follow up with a comment on July 13, saying, "Just because a single build may have ‘leaked’ it does not signal the completion of a milestone such as RTM."

Furthermore, Microsoft’s Windows Communication Manager Brandon LeBlanc warned users against using leaked builds of Windows 7. "As always, beware of what you download. There are many bogus copies of Windows 7 floating around the Internet. More often than not, they contain a rather nice malware payload," he said.

"When Windows 7 hits RTM, it will be announced here," LeBlanc continued. "Until that happens, any builds you are likely to see on the web are either not the final bits or are laced with malicious code."

While German hacker and Team ICE member StreetSkaterFU demonstrated via video (view here – requires Apple Quicktime Software) how the feat was accomplished, in a surprising turn of events, PSP homebrew sceners Alek and Mathieulh confirmed that the exploit was actually doable and real.

A full video in Apple Movie format was released demonstrating how StreetSkaterFU was able to get Warhawk to run without the Blu-ray Disc. Despite the quality and size of the video, the developer claims that this demonstration is not fake. Take note, however, that both StreetSkaterFU and Alek say that this is just a proof of concept for the moment.

Moderator FreePlay of the QJ.NET Forums says that the exploit is actual pretty simple. But according to FreePlay, the exploit is only doable if you have a second hard drive handy and have a good sense of timing.

Various gaming websites confirmed an earlier report by the Wall Street Journal about the upcoming price cut. Ads from Best Buy Best Buy and K-mart as well as an internal memo from GameStop essentially confirm the $299.99 price beginning Sunday, July 13. The price of the $450 Elite system is generally believed to remain unchanged.

Target online has taken it a step further by already offering the Xbox 360 Pro on its website for $299.99.

So, why the price drop?

There may be two sides to the story. One is the life-cycle of the console. As the production matures, production cost goes down (which has been confirmed by Microsoft over the past six quarters) and enables the company to drop the price to make the package more attractive.

On the other side, the Wii and the PS3 have significant momentum and are hurting Xbox 360 sales especially in Europe and Asia. According to NPD, the Xbox 360 was the second worst selling game console in May: 186,600 units were just slightly ahead of the Playstation portable, which sold 182,300 units. Sony sold 208,700 PS3s and Nintendo 675,100 Wiis and 452,600 portable DS consoles.

The answer? the game developers. I’m not sure if you’ve heard, but Blizzard has grown pretty big these days. World of WarCraft has been an indescribable success. It’s been known for a while that Blizzard has been looking at implementing DirectX 10.1 with one of its future games. The fact is that it’s more than one, or two.

If AMD has played its cards right, Blizzard is not only looking to implement DX10.1 support, and in best-AMD-case scenario, DX10.1-exclusive effects, with future games, but also patch current games with DX10.1 for additional performance and effects. If everything comes together for AMD, this means that StarCraft 2, Diablo 3, future World of WarCraft add-ons, and more games from Blizzard will sport DX10.1, something which NVIDIA is unable to handle hardware-wise.

That’s not all though. We recently learned that AMD is looking to team up with more developers, and if there’s one engine that has loved ATI hardware for a long time, it’s the Valve Source engine. ATI is apparently hoping to ensnare Valve as well, and have DX10.1 support with future games like Half-Life 2: Episode 3, Left 4 Dead, Portal 2 and the rest. Knowing how flexible the Source engine is, we wouldn’t be surprised if current games would be patched to further boost performance and additional effects through DX10.1.

Game developers have a tendency to play it safe though, and whether there will be any exclusive effects or not remains to be seen. We see no reason for why they shouldn’t implement DirectX 10.1 though, the worst that can happen is that people with compliant hardware will get a performance boost where DX10.1 makes a difference over DX10.0.

AMD today partially lifted an embargo that prevented hardware review sites from publishing reviews of its upcoming HD 4850 GPU.

Despite previous confusion, it is now confirmed that the GPU will come with 800 stream processors, 965 million transistors, 40 texture units, a core that is clocked at 625 MHz, and 512 MB of GDDR3 memory at 1986 MHz. The maximum power consumption of the card is rated at 110 watts.

In terms of performance, the 4850 goes head to head with Nvidia’s 9800 GTX (which was dropped to $199 today). Reviews published today indicated that the two GPUs deliver a close race in terms of gaming performance. Most reviews we saw today saw the 4850 ahead of the 9800 GTX in games such as Call of Duty 4, FEAR and in the 3D Mark vantage benchmark under Windows Vista. The 4850 came in behind the 9800 GTX in Crysis, ET: Quake Wars, Stalker, Ghost Recon and Grid.

Some may consider Nvidia as keeping the lead and even extending it with the release of the 9800 GTX+ GPU for $229 graphics cards.

But first reviews indicate that AMD has a solid product on its hands. The 4850 version will be announced on June 23 and become available on June 25, according to our sources, followed by the 4870 on July 8 and the 4870 X2 in mid-August.

According to AMD, the new HD 4850 GPU (codenamed RV770) is superior to Nvidia’s GTX200 in several ways. AMD says that on a performance per watt scale, the RV770 GPU comes in at 1.95x while the GTX200 delivers just 1x performance. Memory wise, AMD says that its RV770 GPU supports GDDR5 memory compared to the GTX200’s GDDR3 support. However, current HD 4850 cards on the market that are starting to appear all come with GDDR3 memory. This is because the HD 8450 cards all use the RV7700 Pro GPU. Those who want GDDR5 will have to wait for cards using the RV770 XT.

The RV770 XT is expected to launch within several days, with an even higher clock speed of 750MHz compared to 625MHz for the RV770 Pro. Because of the memory difference, the overall bandwidth for a board using a RV770 XT is nearly double that of a RV770 Pro board — 115.2GB/sec. vs. 64GB/sec.

Example reviews:

Despite the fact that the download pages were virtually not reachable for several hours after the software was officially released at 1:16 PM EDT today (we actually found it posted on Mozilla’s FTP server at 1:31 PM EDT), lots of download requests apparently were successful.

Eight hours after the release of the software, the download counter stood at almost 2.92 million downloads. Mozilla’s own goal was to hit more than 1.6 million Firefox downloads within 24 hours to set a Guinness world record. Firefox 2 was downloaded about 1.6 million within one day after launch. Mozilla said that it will take about one week to review download logs and validate the record attempt.

So far, more than 1 million downloads came from the U.S., more than 100,000 from Brazil, Canada, Germany, Japan, Spain and the UK.

TorrentFreak spoke with Kevin Kowalewski of TorrentRelay, which is designed to bring BitTorrent functionality to platforms that don’t support a native torrent client, such as the PlayStation 3, Wii or iPhone.

As we had an iPhone to hand, we decided to give this system a go, choosing the easy mininova option (detailed below) and downloading a single .jpg image from a wallpaper pack. In just a few seconds the image appeared in Safari as promised, but due to limitations in the current version of Safari, it wasn’t directly possible to save the image. I know there is an addon somewhere that already provides this functionality, if only I could find it…but the file transfer component worked fine.

Here is a video showing the process on PS3. We follow up with an interview with Kevin below:

Pegatron Technology, an OEM subsidiary of Asustek Computer, is reported to have received the winning order from Microsoft for a Blu-ray equipped XBOX 360.

Earlier reports cited Lite-On as the company with the privilege of building the new console for Microsoft. Lite-On is also currently one of the suppliers of the internal DVD drive fro the XBOX 360.

One of the strong points for Sony’s Playstation 3 has been the integrated Blu-ray player. The PS3 had the ability to draw both gamers and audio/video enthusiast, and this was proving to be a major advantage over its XBOX rival. It is estimated that 85% of Blu-ray players in use are PS3s. Microsoft chief executive Steve Ballmer had admitted that Microsoft had been working on support for Blu-ray under Windows during this year’s Mix08 conference. Rumors began to swirl and many began to expect Microsoft to announce a Blu-ray peripheral for the XBOX 360.

However, Microsoft came out and denied all rumors, stating that they were not exploring any kind of Blu-ray add-on or in talks with Sony about integrating Blu-ray into the XBOX experience. The software giant stated they would continue to invest in its XBOX Live online service as the means of high-definition content delivery. Toshiba received a crushing blow earlier this year at CES that Warner Brothers would be Blu-ray exclusive. This eventually led to Toshiba withdrawing from the HD format war and the demise of the XBOX 360’s HD-DVD add-on. It is interesting to note that sales of the XBOX 360 lagged behind Sony’s PS3 in the month of February, the same month Toshiba withdrew.

Many expected the death of HD-DVD would trigger a growth in Blu-ray hardware sales. However, to the dismay of the industry, acceptance and adoption of Blu-ray has been dismal.

The PS3 is one of the cheapest (relatively speaking) Blu-ray players available — and you get the console thrown in for good measure.

David M. Fish, 26, of Woodbury, Connecticut, was further sentenced to three years on probation this week after he pleaded guilty to criminal copyright infringement and circumvention offences. The computer equipment used by Fish to commit the offences was forfeited.

Fish served as the site operator as well as a scripter, equipment supplier, broker and encoder for warez sites between January 2003 and July 2005, according to court papers. His work involved circumventing copyright controls on DVDs and uploading content.

The case is part of Operation Copycat, an investigation by the FBI and the US Attorney’s Office targeting online warez groups that illegally distribute newly-released movies, games, software and music online. Operation Copycat has resulted in 40 convictions thus far as part of a larger federal crackdown against the illegal distribution of copyrighted materials, known as Operation Site Down.

Sony and Samsung have independently started shipping new Blu-Ray devices to meet the increasing demand in high-definition video worldwide. The new devices are not only a passport to the high-definition digital world, but also the creation of two major trendsetters in the industry, having been among the key factors that triggered the death of Toshiba’s HD-DVD.

Sony announced two new Blu-Ray players that can also burn HD media, called the BDZ-A70 and BDZ-T90. The latest Blu-Ray burners come with hard-disk drive and dual-tuners for Japan’s digital TV broadcasting system. While the BDZ-A70 model features a 320 GB hard disk and an iLink port able to connect a DV camcorder, the BDZ-T90 packs a 500GB hard-disk drive but lacks the iLink connector.

For the moment, the two units are available on the Japanese market only and sell for an estimative retail price of $1583. Although the two burners do not share the same technical specifications, they sell at identical prices because the iLink port compensates for the storage space difference.

Sony’s new products are part of the company’s commitment to promoting the Blu-Ray standard. Last year, Sony announced that all its upcoming digital video recorders will be compatible with the Blu-Ray technology.

On the other side, Samsung released a single Blu-Ray player called the BD-P1500. The new device supports full-HD 1080p playback but it can also work with other optical media, such as CDs and DVDs. When playing DVD movie titles, the Blu-Ray device upconverts the resolution to 720p, 1080i and 1080p.

However, Samsung’s newest addition comes without support for the BD-Live technology, an interactive system that allows users to enjoy gaming, e-commerce and the whole Internet experience using a wired connection. The new feature will kick in during the following months. However, according to the company, a firmware update will fix the problem at no extra cost.

Samsung will release its BD-P1500 drive in mid-May at an estimative price tag of about $395.

In addition to changing the formula for searching specifically for image results, Google said its new technology also takes into account pictures that look similar, grouping those results together.

“We wanted to incorporate all of the stuff that is happening in computer vision and put it in a Web framework,” the New York Times quoted senior Google researcher Shumeet Baluja saying at the International World Wide Web Conference.

Google researchers say image recognition and searching has been one area of technology that has lagged behind as other areas have enhanced.

The online giant says it has the “most comprehensive image search on the Web,” but it currently relies largely on key text phrases associated with the pictures.

In structuring the new technology, the Times reports that Google first focused on specific items that ranked as top searches on Google Products (formerly known as Froogle). It then moved to matching an image search, for example, for “iPod” by scanning Google’s massive image index for pictures that matched the actual file photo of an iPod than for images with the word “iPod” attached to it.

The quarter result reflects decreased Windows Vista sales revenue, which are a result of $1.7 billion of deferred Windows Vista Express upgrade revenue reported by Microsoft in its fiscal third quarter of last year. Overall, client revenue came in at $4.01 billion, down from $5.3 billion last year. The decrease was partially offset by a 5% increase in OEM license units. Microsoft noted that revenue from commercial and retail licensing of Windows operating systems climbed $71 million or 4% during the nine months ended March 31, 2008, primarily due to sales from Enterprise Agreements and anti-piracy efforts in emerging markets.

Much of the third quarter success was driven by the company’s entertainment devices division. The company sold 1.3 million game consoles during the quarter and 7.5 million devices during the first nine months of its fiscal year.

Despite increased revenue from Aquantive, Microsoft’s online division dipped deeper into the red: Sales jumped from $603 to $843 million year over year, while the loss increased from $171 million to $228 million.

In their ever continuing battle to free the Internet, The Pirate Bay has now launched an uncensored blogging service, called Baywords. The service is intended to be a safe haven for bloggers who want to be able to write whatever they want, without being afraid to get shut down by their blog host.

The Pirate Bay is known for defending people’s right to freedom of speech on the Internet, and this is exactly what motivated them to start this new blogging service.

Brokep, one of the co-founders of the site, said that the idea to start a blogging service came up when the weblog of one of his friends was taken down from WordPress recently, for linking to copyrighted material.

This, of course, goes against the “uncensored web” philosophy of The Pirate Bay team, and they didn’t hesitate to start their own blogging service, Baywords, using WordPress as their blogging engine.

On the frontpage of the newly launched service Brokep writes: “Many blogs are being shut down for uncomfortable thoughts and ideas. We will not do that. Our goal is to protect freedom of speech and your thoughts. As long as you don’t break any Swedish laws in your blog, we will defend it”.

In a response, Matt Mullenweg from WordPress said that he supports Pirate Bay’s Baywords, but he assured us that WordPress.com would never take down a blog for posting deviating thoughts or ideas.

“WordPress.com supports free speech and doesn’t shut people down for “uncomfortable thoughts and ideas”, in fact we’re blocked in several countries because of that. However as a US-based companies we must comply with US laws, which means if the primary purpose of a blog is distributing illegal material it’s not a good fit for WordPress.com,” Matt said.

Baywords is currently working on expanding the feature list to include support for domain redirects and improved stats. The service is ad-free for now, but Brokep said that there will be ads blended into the blog design later, to cover the expenses.

This is not the first time The Pirate Bay has started a service where people can publish whatever they want, without being censored. They already created an image hosting service for this reason, and a YouTube competitor is about to follow soon.

For people who are considering moving their WordPress or Blogger account over to Baywords, importing is pretty straightforward and compatible with all the popular blog platforms.

According to video game company Enterbrain, a new DS model may be on the way with added functionality, but it is unclear if it would be an official successor to the Nintendo platform.

Bloomberg Japan reports that the head of Enterbrain, Hirokazu Hamamura has predicted that the new DS model will be revealed during E3, the world’s biggest video game trade show.

The prediction is in step with a statement Nintendo made earlier this year. “All I can tell you is what we announce during E3 is gonna be fantastic,” said company VP Reggie Fils-Aime in an interview with MTV’s GameTrailers.

The DS first launched in the US in November 2004, so it is about time for a new model. A refreshed version of the system, the DS Lite, came out in 2006 and effectively phased out the original model. However, there is no difference in functionality with the Lite.

According to Hamamura, the new DS will likely include the ability to play back music and movies, and also an additional slot for external hardware components.

The DS has sold more than 16 million units in the US alone making it far and away the leading handheld platform. It typically outsells the PSP by a margin of two-to-one, and continues to sell better than any of the home consoles.

The site has made its comeback after exactly 6 months of downtime.

A message posted on the Demonoid frontpage confirms that Deimos, the former administrator, left the Demonoid staff. The site seems to be working properly, as does the tracker, but there could be some downtime in the next few days. All the people who had an account at the time the site shut down can still sign in with the same username and password.

The resurrection of the popular BitTorrent traffic marks the end of a tough year for the site. The trouble for Demonoid started back in June last year, when the Dutch anti-piracy outfit BREIN started to put pressure on Demonoid and their ISP, Leaseweb. Deimos decided that the Netherlands wasn’t the safe haven it used to be and he to moved the site to Canada, which resulted in a few days of downtime.

Deimos never really told the administrators or members of the site exactly what was happening. Initially, most members assumed that there was some hardware failure, but after a few days it became clear that Demonoid was more or less forced to move. Maybe there could have been hardware failures too, who knows, but the outcome was the same – Canada here we come.

Relocating the servers to Canada initially solved the problems, but, by the end of September Deimos took Demonoid offline for the second time. Again, nobody knew what was going on until we found out that the CRIA was responsible for the downtime, which was later confirmed by Deimos. It turned out that Canada wasn’t the best choice after all.

After 5 days of downtime the site returned, now blocking all traffic from Canadian users in an attempt to calm down the CRIA. At first it looked like the storm was finally over, but on November 9th Demonoid’s users were welcomed by a disappointing message on the frontpage explaining that the CRIA was indeed responsible for the downtime.

The site never came back after November last year, up until now that is. Let’s hope it lasts this time.

Determining the difference between a level two and level three hurricane may be done in the future by measuring the sound instead of flying in airplanes in the middle of it at several hours throughout the day.

The Massachusetts Institute of Technology has developed a new, more cost-effective way of measuring the intensity of a hurricane.

Right now, the official way of determining hurricane strength is by sending in “hurricane hunters” that fly into the middle of the storm in durable airplanes, clocking the wind speeds as they pass.

However, according to MIT, the planes cost nearly $100 million each, and each individual flight costs around $50,000. This makes monitoring a single hurricane a very expensive ordeal, and the technology surrounding it hasn’t changed all that much.

The new research from MIT has looked at placing out underwater microphones in the path of a hurricane. By measuring the amount of sound an oceanic storm produces, scientists can determine how fast the sustained winds are.

“There was almost a perfect relationship between the power of the wind and the power of the wind-generated noise,” said MIT’s director of undersea remote sensing and a researcher in the project Nicholas Makris.

In the future, weather trackers could place the hydrophones underwater before the storm approaches and remotely monitor the results, leading to a cost of just a fraction of conventional hurricane measuring techniques.

Moreover, say scientists, the technology could also be used to more effectively study climate change. According to MIT, the hydrophones can measure the amount of sea salt coming into the atmosphere, which it says is an indicator of the planet’s climate.

In a move smacking of hypocrisy though, officers involved will not be charged.

According to The Australian, during an audit of computer systems by the South Australian police force’s IT branch, police computers belonging to hundreds of police officers were found to contain movies.

The origin of these movies is not clear, but it is probable that they’ve been downloaded via p2p at some point, either on these systems, or on the personal systems of officers and transferred over.

Senior officials of the SA police force have been made aware of the findings, including its commissioner Mel Hyde. However, police sources have told press that there will not be any investigation into this, citing the large numbers of police officers involved.

The Australian Federation against Copyright Theft (AFACT) has said it will write to the commissioner to seek an explanation, presumably as to why the police officers are being let off with what it considers a heinous crime. Quite ironically, AFACT boasts of “working closely with police” – perhaps this closeness has shown the police officers involved just how unimportant and meaningless this so-called ‘crime’ is in the grand scheme of things.

If the officers do go unpunished, it could create a favorable precedent for filesharers in South Australia. If police officers, who are expected to be held to a greater level of accountability regarding the law, show this level of contempt for the current copyright laws, are unpunished, it will make it harder to convince a court that regular citizen should be punished for similar acts.

On the other hand, if the officers are punished under the law, which allows for upto AUS$60,500 (About US$55,700 or 35,500Euro) per infringement and up to 5 years imprisonment, the ability to effectively police the state will be severely diminished.

Either way, this case will bring to a head the vastly disproportionate penalties for an act that, as yet, has never been proven to be even financially damaging. One thing is certain, when even the police officers join large numbers of citizens in flouting such laws, the law’s place in society should be called into serious question.

The South Australian police force had not responded to requests for comment at the time of publication.

Using its browser plugin Google Gears, the company says it’s rolling out offline functionality to its online office applications over then next few weeks. Users will be able to tell when their accounts have been upgraded with the new capability when an “offline” link appears at the top of the Google Docs site.

Though both Docs and Gears are still both beta, the move is a salvo in Redmond’s direction, taking direct aim at Microsoft’s entrenched, proprietary, industry-standard Office productivity software suite. Conversely, Google Gears is an open-source project that any developer can use to build offline capability into web applications.

“Web applications such as Remember the Milk and our own Google Reader already use Gears. Google Docs is just the latest to join the party. We’re inviting developers to Google I/O on May 28-29 to see how we did it and learn how they can do the same” said Google representative Jason Freidenfelds.

The offline capability will be limited to word processing documents, though the company plans to add it to spreadsheets and presentations in the future. “We’re working to make more web applications and functions work where connections are unavailable (including editing spreadsheets and viewing/editing presentations, and bring offline functionality to other apps). But this gives a taste of the future, when you’ll always be able to access the cloud” added Freidenfelds.

You can find out more about the development and watch a video demo on the Official Google Blog.

PirateBay moves to Egypt

Due to the new copyright legislation that are going to take effect from today we had to move all of the system outside of Europe.

We decided to move to the desert of Sinai in Egypt since we feel that we’ll be safe there. Tiamo has already got himself a permanent place to live and will reside in Sinai from now. Those of you who need to get in contact with him can use the contact page.

In Sinai we’ve set up the systems with three redundant fibre links. Besides local connectivity in Egypt we also have connectivity to Saudi-Arabia and Israel. Jordan is quite close and we hope to install a link there as well as soon as our budget will reach that level. This way we’re actually hosted in Asia as well as Africa.

More updates on this will come later today, hopefully. Everything will be the same as before, we will have slightly higher latency for European and American visitors.

A special note to Ifpi: Moses walked in the desert of Sinai for 40 years. Our servers will be active for at least another 40 as well.

It’s probably another Aprils Fool’s Day Joke like the one they did last year, when they announced on their blog that they are moving all their servers to the North Korean embassy in Stockholm
