Thanks for the warning but its a little long over due, even tho i haven’t seen the torrent yet or gotten it, but i would of known better anyways, but to comment on india and whoever else, it is entrapment but under the law they’re able to do it, just like when cops sit on the side of the road with out their lights on, basically if they’re not in physical view then its entrapment but it doesn’t hold up in the court of law so just think of that shit as not even being true anymore. they see it as an illegal act so you need to pay the piper, and america needs the money so beware and be careful.

    joe, it goes to intent, your intent is to illegally download that movie, therefore in court they can use that intent to gain a conviction or civil penalties. as for the ounce of flour, it’s all up to what you represent the ounce of flour to be, if you claim it is heroin or cocaine then under the eyes of the law, it has to be prosecuted as if you really had an ounce of heroin or cocaine. yes the usa has laws concerning fakes that impose the same penalties as if they’d been real.

  22. AS a prior cop, intent was fine, if there was a crime committed. Their had to be a conspiracy to commit a crime, as far as I can tell, just downloading a movie with the same name as a movie that might be due out in 3 months, is not conspiracy to commit. With drugs, they are illegal and even at that, it would be hard pressed to sell an ounce of flour to someone and not get a conviction without cocaine being present in some part of the bust. Granted I havnt been a cop now for nearly ten years but I have trouble believing things have changed that much. Movies are not an illegal possession to own, and using the bit torrent system is legal also so the only crime I see that is has been perpetrated is they release of a copyrighted material on a bit torrent server by mpaa. This theory is all under the assumption the torrent is a fake copy of the actual movie, like I said if it was real then the mpaa committed a crime also.

    All they have to do is include *SOME* copyrighted material – even the trailers are copyrighted, but they’re considered to be released to the public and legal as ‘Fair Use’ – I don’t remember off the top of my head how many minutes (seconds?) can be used under the ‘Fair Use’ exceptions, but they’ll probably use a 5-10 minute clip + ‘Filler’.

    I wonder how many VPN’s & proxies I can bounce a torrent through? I know a few in China (PRC), plus USA, Scandinavia, South Africa, Australia, Brazil, the Caribbean, etc. Hmm…

    I love living in Canada!! Its still legal to download :) You just cannot make profits off it. Its legal to keep a digital and/or dvd copy of that movie, for “back-up”.

    industry trade groups are using flawed tactics in their investigations
    of users who violate copyrights on peer-to-peer file sharing networks.

    Those trade groups, including the Motion Picture Association of
    America (M.P.A.A.) Entertainment Software Association (E.S.A.) and
    Recording Industry Association of America (R.I.A.A.), send
    universities and other network operators an increasing number of
    takedown notices each year, alleging that their intellectual property
    rights have been violated under the Digital Millennium Copyright Act.

    Many universities pass those letters directly on to students without
    questioning the veracity of the allegations. The R.I.A.A. in
    particular follows up some of those notices by threatening legal
    action and forcing alleged file-sharers into a financial settlement.

    But the study, released Thursday by Tadayoshi Kohno, an assistant
    professor, Michael Piatek a graduate student, and Arvind
    Krishnamurthy, a research assistant professor, all at the University
    of Washington, argues that perhaps those takedown notices should be
    viewed more skeptically.

    The paper finds that there is a serious flaw in how these trade groups
    finger alleged file-sharers. It also suggests that some people might
    be getting improperly accused of sharing copyrighted content, and
    could even be purposely framed by other users.

    In two separate studies in August of 2007 and May of this year, the
    researchers set out to examine who was participating in BitTorrent
    file-sharing networks and what they were sharing. The researchers
    introduced software agents into these networks to monitor their
    traffic. Even though those software agents did not download any files,
    the researchers say they received over 400 take-down requests accusing
    them of participating in the downloads.

    The researchers concluded that enforcement agencies are looking only
    at I.P. addresses of participants on these peer-to-peer networks, and
    not what files are actually downloaded or uploaded—a more resource-
    intensive process that would nevertheless yield more conclusive
    information.

    In their report, the researchers also demonstrate a way to manipulate
    I.P. addresses so that another user appears responsible for the file-
    sharing.

    An inanimate object could also get the blame. The researchers rigged
    the software agents to implicate three laserjet printers, which were
    then accused in takedown letters by the M.P.A.A. of downloading copies
    of “Iron Man” and the latest Indiana Jones film.

    “Because current enforcement techniques are weak, it is possible that
    anyone, regardless of sharing content or using BitTorrent, could get a
    D.M.C.A. takedown notice claiming they were committing copyright
    infringement,” said Mr. Piatek.

    In their paper, the researchers argue for greater transparency and
    public review of Big Media’s intellectual property enforcement actions.

    “Our study scientifically shows that flaws exists,” said Mr. Kohno, an
    assistant professor in the university’s Computer Science and
    Engineering department. “It’s impossible to prove that other flaws
    don’t exist, especially since current industry practices are so
    shrouded in mystery. Ultimately, we think that our results should
    provide a wake-up call for more openness on the parts of content
    enforcers.”

    There are so many flawed points here so to touch on a few..

    a.it’s not entrappment any more than it is when cops pose as dealers and then bust people who buy the drugs. Just because they present an opportunity doesn’t mean they are forcing you to do something. If you approach them and say hwhat you got give me 50 bucks worth of rock you get arrested. They do it everyday. To not hold up they would have come to you and threaten you if you don’t buy it.. or if they were to say I am a cop don’t worry about doing this it is legal to do so ( not about drugs per say just in general. If they were to say hey we represent dream works (movie company)here get this movie we don’t care and then when you do they pursue it criminally. Now that they cant do.

    b.copyright infringement guys has to do with permissions. The movie company can and has done before this same thing. They give the mpaa special permission all the time to do things like this. It has nothing to do with dl’ing being illegal or selling distributing etc, again it is doing so without the permission of or by the intillectual property owner. Again to be entrappment they would have to say dont worry about it the studio has given permission for you to dl this free of charge so go ahead and do it.

    c. This is the kind of thing they can do to secure legal warrants to look at everything you are doing . See they take this to the judge and say your honor here is our proof they are doing something illegal and we have reason to believe they might be selling these on a larger scale. So we want a warrant to look into their life deeper, tap their phones monitor the internet traffic so on and so forth. Why would they do that you’re paranoid man.. no they are doing this to try to find those people who are dling and duplicating counterfeiting etc etc on a large scale. In order for it to stick in court they have to go by the book and show what probable cause they had to investigate you. We all know its the F.B.I who looks into this activity they tell you on every movie you watch “FBI warning”.

    d.Also to show a real life example…cops will all tell you they pull people over for traffic citations because 80% of all arrests start this way. They see you driving and say that guy smokes dope or is black or whatever the reason . So I am gonna follow him and wait for a traffic violation to pull you over. They don’t give a sh#$ you didn’t signal they are coming up looking for signs of other illegal activities..i smell pot in your car or I can see in plain sight a pack of rolling papers or piece of steel wool anything to get that reasonable suspicion of something. At that point they can run a dog around or search through themselves. They want to find the big bust in the trunk or whatever you are up to if anything. Come on guys this is their job and they love doing it.

    e.The biggest point is and the real reason they want to go after us is this. they have all the money and time in the world to take you to court. you and i don’t and thats what they want you to do. They have publicly stated before this very strategy. They are not dumb and don’t really want to win a civil judgement for that money they don’t need it. They are saying in essence that’s fine you want to d.l. it for free okay but you will pay for that movie one way or another . We are going to drag you to court make you miss work, put stress on you everyday, make you pay huge amounts of money defending yourself, basically just making you never want to go through it again…and to send that message to everyone else who is paying attention to the case.

    and yeah just for sitting on your ass you can get from 1.500-2.000$ a month for doing nothing :) well again we are one of the riches nation in the world.

    And yeah whats up with the the dragonball movie 70min in asia and in usa it is 100 min ????? that just dont make any sence.
